This Vehicle Sourcing & Concierge Buying Agreement ("Agreement") is entered into between Barbera Motorcars LLC d/b/a Barbera Luxury Motorcars ("Dealer") and the undersigned client ("Client"). The purpose of this Agreement is for Dealer to assist Client in locating, evaluating, negotiating, and facilitating the purchase of a motor vehicle through a third-party dealer or seller.
Scope of Services
- Research and identify vehicles meeting Client’s criteria.
- Communicate with selling dealers or sellers.
- Provide vehicle history information when available.
- Assist in negotiating price and terms.
- Assist with coordination of inspections, transport, or delivery if requested.
- Introduce Client to the selling dealer for completion of the purchase transaction.
Compensation
Client agrees to pay Dealer retainer and success fees for services provided (non-refundable and credited toward final sourcing fee). Due upon Client entering into a purchase agreement for a vehicle identified or negotiated by Dealer. Dealer may alternatively receive compensation directly from the selling dealer in the form of a referral or brokerage fee.
Non-Circumvention
Client agrees that for a period of six (6) months after introduction to any vehicle or seller provided by Dealer, Client will not bypass Dealer to purchase the vehicle directly from the seller or dealer without paying the agreed sourcing fee.
Dealer Licensing Disclosure
Barbera Motorcars LLC is a licensed motor vehicle dealer in the State of Louisiana. The final retail purchase transaction will be completed between Client and the selling dealer or vehicle owner.
Limitation of Liability
Dealer makes no guarantees regarding vehicle condition, availability, or financing approval. Client is responsible for performing final due diligence and inspection prior to purchase.
